Five Federal Lawsuits Against the Biden Title IX Rule

Five lawsuits have been filed in federal court against the new Title IX rule in the span of eleven days since the Biden administration published it. They are:

State of Alabama v. Cardona, 7:24-cv-00533 (complaint)
State of Tennessee v. Cardona, 2:24-cv-00072 (complaint)
State of Louisiana v. U.S. Dept. of Education, 3:24-cv-00563 (complaint)
State of Texas v. The United States of America, 2:24-cv-00086 (complaint)
Rapides Parish School Board v. U.S. Dept. of Education, 1:24-cv-00567 (complaint)

You can download a spreadsheet of the lawsuits here. While all five lawsuits address gender identity (trans) issues, only one – State of Alabama v. Cardona – squarely addresses due process concerns (see in particular pages 27-31).

I anticipate that more lawsuits will be filed because of the far-reaching nature of the new Title IX rule, but it seems clear that gender identity issues are now center stage as far as public perception of Title IX matters goes.
