As announced in our recent Vision and Roadmap post, we are focusing on developing new database tools aimed at assisting during Title IX grievance procedures. We have recently added a new “Provisions” section to our Title IX Lawsuits Database and its free trial. The purpose of this new section is to provide an efficient means of locating and citing key provisions in Title IX and FERPA regulations regarding grievance procedures and disciplinary outcomes. These provisions are often diffused throughout the regulations rather than consolidated exclusively into dedicated (sub)sections.
I’ll walk you through some of its features.
Table of Citations
The first is a rather simple table of citations. Clicking on citations in the “Link” column will take you directly to their source in the Code of Federal Regulations. For example, clicking on 34 CFR 106.45(b)(1)(i), the citation link in the third row, will take you here. Also, clicking on links in the “Provision” column will take you to that provision’s “Details” page. More on that soon. For now, here is the Citations table:
Search Engine
Using this tool, users can search by such pre-defined terms as “advisors,” “cross-examination,” “appeals,” and so forth. The search engine will display all provisions in the current Title IX regulations regarding such terms along with links and citations. Here is a sample screenshot:

We have also included a table of provisions with a short summary/description of each. We imagine these summaries will be particularly helpful to those entirely new to Title IX matters; while many of them are fairly intuitive, others are not. The table includes a button to access a “Details” page with all regulatory citations regarding specific provisions.
“Details” Pages
For example, clicking on “Appeals” in any “Provisions” field will take you to its “Details” page, which contains seventeen regulatory citations (only two of which can be displayed in the screenshot):

Currently, there are thirty-four provisions users can search for:

We plan to expand the Provisions section to track any future regulatory changes regarding Title IX grievance procedures whenever such final rules are published. Users will be able to compare/contrast new and old regulatory provisions.
Ideally, we will also expand this section to allow users to search for all key judicial decisions in the 800+ lawsuits filed by accused students that mention specific provisions on cross-examination, hearings, notice, bias, and so forth.

Accused Students Database
Research due process and similar lawsuits by students accused of Title IX violations (sexual assault, harassment, dating violence, stalking, etc.) in higher education.
OCR Resolutions Database
Research resolved Title IX investigations of K-12 and postsecondary institutions by the Department of Education’s Office for Civil Rights (OCR).
Attorneys Directory
A basic directory for looking up Title IX attorneys, most of whom have represented parties in litigation by accused students.
