Due process issues under Violence Against Women Act reauthorization, SCOTUS rules against emotional distress claims in federal civil rights statutes, and more.
Every month, we distribute a โTitle IX Recap,โ providing a highlight of the previous monthโs litigation, advocacy, and other Title IX-related matters. “There is no doubt that compliance with these expanded obligations places new burdens on colleges and universities. As deadlines approach, colleges and universities participating in NCAA athletics should become familiar with the new requirements now to ensure they implement procedures necessary for compliance.”
“The U.S. Supreme Court on Thursday ruled 6-3 that damages for emotional distress are not available in key federal civil rights statutes barring race, sex, and disability discrimination.”
“The Biden administration’s scrutiny of its predecessor’s regulations on due process in campus sexual misconduct proceedings may face complications from state attorneys general and recent developments in state law and litigation.”
“The Biden administration had said it plans to issue a draft version of its rule this month. However, the Education Department scheduled meetings to discuss the regulation through May, implying a potential delay.”
“University of Virginia’s College at Wise on Tuesday formally adopted the Tracy Rule, which requires thorough background checks for athletes and bans those found responsible in a Title IX hearing or court for sexual or violent offenses from playing on varsity sports teams.”
Oklahoma recently passed HB3543, which aims to protect free expression in higher ed from disruptive tactics favored by illiberal left (“woke”) activists.
“Womenโs scholarships, leadership programs, awards and even gym hours are being eliminated or canceled by universities because they discriminate against men. Complaints are being filed with the Department of Education (DOE) about programs and funding for women at universities across the country, and the DOE is taking action.”

Michigan State University has settled with John Doe who sued after the school’s grievance process found him responsible for sexual assault. Judge Janet Neff had previously denied the motion to dismiss.
“In a unanimous decision, the U.S. Court of Appeals for the Sixth Circuit held that Meriweather sufficiently alleged Shawnee State burdened his rights to freedom of speech and religious expression by insisting he refer to a student using feminine pronouns.”
โAnti-constitutionalists,โ by contrast, are so impatient to address what they see as grievous wrongs that they end up taking legal shortcuts. The consequences of โanti-constitutionalism,โ suggests Busch, may be dire.
