Fifth Circuit Affirms Accused Student Summary Judgment Win on Title IX Claim

“We agree that these facts taken together, or in isolation, implicate serious due process concerns and now turn to the merits of Doe’s Title IX arguments.”

Update on Katie Meyer Lawsuit

The parents of the deceased Katie Meyer, who committed suicide after being accused of violence, filed a lawsuit against Stanford in November. The school’s demurrer (like a motion to dismiss) was granted/denied in part in early May.

Dordt University Settles with Accused Student

The settlement comes before trial but after a strong and favorable Title IX summary judgment holding.

Student accused of sexual assault sues UC

Joshua Engel, representing the Plaintiff: “Everyone — victims, the accused, faculty, attorneys — wants a process that leads to accurate and reliable results. Instead, UC has again chosen to adopt practices that reinforce and rely upon gender stereotypes and abrogate the due process rights of students.”

Former Bills punter Matt Araiza was not present at time of alleged gang rape, prosecutors say

“Prosecutors in San Diego say former Buffalo Bills punter Matt Araiza was not present at an October 2021 party when an alleged gang rape of a minor occurred, according to documents and audio recordings obtained by Yahoo and ESPN.” Relatedly, SDSU “concluded…there are no findings against former Buffalo Bills punter Matt Araiza.”

Motion to Dismiss Granted in Holmstrom v. University of Tulsa

The sole claim was Title IX against all defendants. “At best, these allegations raise an inference of pro-victim or anti-respondent bias, which is not the same as anti-male bias.”

Final Title IX rules delayed to October 2023

“The U.S. Department of Education has pushed back by five months — until October — its planned May release of both the final Title IX athletics and the broader Title IX rules. The change comes in light of the high volume of feedback received during the comment periods for the proposed rules.” Here is an update directory from ED.

One Person Lodged 7,339 Sex Discrimination Complaints With Ed Dept. Last Year

“In 2016, the more than 6,000 complaints filed by that same individual alleged discrimination in school athletic programs, according to the civil rights office. Fiscal year 2022 followed much the same pattern when the office logged 4,387 allegations of Title IX discrimination involving athletics.”

The latest group to get special attention from college admissions offices: men

“‘More educators would be inclined to help boys and men if it weren’t for mistaken assumptions about that male privilege,’ said Ioakim Boutakidis, a task force member and professor of child and adolescent studies at California State University Fullerton. Boutakidis said he has encountered that pushback at his own campus as he has tried to get the university to pay attention to male enrollment and academics.”
